At a Borough Council meeting on 5/21/08 a Council member asked the Borough solicitor to explain the meaning of the term Surcharge in regards to its relation to the parking garage issue. The solicitor's response to that inquiry seemed more than a bit ambiguous to those attending the meeting. Upon reflection, the solicitor's response seems even more odd because it turns out the solicitors law firm, about five months earlier, had done nearly three hours worth of research on the subject of Surcharge as it related to the subject of the parking garage. Fortunately our group's lawyer was in attendance and was able to clarify for Borough Council and the residents how the Surcharge issue could impact individual Council members and Borough employees. If you read through the definition you can see why it is important that the Borough Council members be fully informed of all pertinent facts in relation to multi-million dollar land development deals. It is common sense that Council members, in their role as government officials, should be aware of their own monetary liabilities as well as those of the Borough as a whole.
